KOBO SPORTS LLC TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern your access to and use of KOBO Sports LLC websites, online stores, products, services, and purchases from KOBO Sports LLC ("KOBO," "we," "us," or "our").

By accessing our website, creating an account, placing an order, or purchasing a KOBO product, you acknowledge that you have read, understood, and agree to these Terms and the policies incorporated into them.

If you do not agree to these Terms, please do not use our website or place an order.

1. About KOBO

KOBO Sports LLC is a United States company registered in Arizona.

KOBO designs, markets, and sells sporting goods, including pickleball paddles, accessories, apparel, equipment, and related products and services.

2. Eligibility to Purchase

By placing an order with KOBO, you represent that you are legally capable of entering into a binding agreement; the information you provide is accurate and complete; you are authorized to use the payment method submitted with your order; and your purchase is for lawful purposes.

KOBO reserves the right to refuse or cancel an order where fraud, unauthorized payment activity, pricing errors, inventory errors, policy abuse, or other legitimate concerns are identified.

3. Product Information

KOBO makes reasonable efforts to provide accurate product descriptions, photographs, specifications, dimensions, weights, colors, performance information, and other product details.

Because sporting goods may contain materials and components with normal manufacturing tolerances, minor variations may occur between individual products. Product photographs and colors may also appear differently depending on lighting, photography, display settings, and device screens.

KOBO may improve, update, or modify products, packaging, components, specifications, or included materials from time to time, provided such changes do not materially misrepresent the product purchased.

4. Pricing and Availability

Prices are displayed in the currency indicated on the website and may change without notice.

Promotions, discount codes, free gifts, bundles, and special offers may be subject to separate eligibility requirements, expiration dates, exclusions, quantity limitations, or other promotional terms. Unless expressly stated otherwise, discount codes and promotional offers may not be combined.

Product availability is not guaranteed until an order has been accepted and processed. If a product becomes unavailable after an order is placed, KOBO may contact the customer regarding available options, including delayed fulfillment, an alternative resolution, or cancellation and refund where appropriate.

5. Orders and Order Acceptance

After you place an order, KOBO may send an electronic acknowledgment confirming that the order was received. An order acknowledgment does not necessarily constitute final acceptance of the order.

KOBO reserves the right to verify payment, shipping information, product availability, suspected fraud, pricing errors, and other order information before fulfillment. KOBO may decline or cancel an order before shipment where reasonably necessary.

Once an order enters fulfillment, cancellation may no longer be possible.

6. Payment

Customers agree to provide current, complete, and accurate payment and billing information.

By submitting payment information, you authorize KOBO and its payment-processing providers to charge the applicable purchase amount, taxes, shipping charges, and other amounts disclosed during checkout.

Payment services may be provided by independent third-party payment processors and may be subject to their own terms and conditions.

7. Order Processing and Shipping

KOBO fulfills orders through multiple logistics and fulfillment locations. The fulfillment location, carrier, and shipping method may be selected by KOBO based on inventory availability, destination, service availability, and operational requirements.

Processing and delivery timeframes are estimates and are not guaranteed delivery dates. Carrier delays, customs processing, weather, transportation disruptions, peak shipping periods, inventory availability, government inspections, and other circumstances outside KOBO's reasonable control may affect delivery.

Complete shipping terms, including international shipping, duties, customs, delayed shipments, lost shipments, incorrect addresses, and packages marked as delivered, are governed by the KOBO Shipping Policy. The Shipping Policy is incorporated into these Terms by reference.

8. Customer Shipping Information

Customers are responsible for providing a complete and accurate shipping address, postal code, telephone number, and other information required for delivery.

Address changes cannot be guaranteed after an order enters processing or has been shipped.

KOBO is not responsible for delays, failed deliveries, additional carrier charges, or losses resulting from incorrect or incomplete information supplied by the customer, except where otherwise required by applicable law.

9. Order Cancellations

Cancellation requests should be submitted as soon as possible. KOBO cannot guarantee cancellation after an order has entered processing or fulfillment.

Orders that have already shipped cannot be cancelled and will be subject to the applicable Return & Refund Policy after delivery.

10. Returns and Refunds

KOBO provides a 30-Day Return Policy for eligible new, unused products, subject to the requirements, exclusions, inspection procedures, and Return Authorization process stated in the KOBO Return & Refund Policy.

Used paddles are not eligible for refunds under the standard return policy. All returns require authorization from KOBO before the product is shipped back.

Return authorization does not guarantee a refund. Returned merchandise remains subject to inspection and final eligibility determination.

Complete return and refund requirements are governed by the KOBO Return & Refund Policy, which is incorporated into these Terms by reference. Where these Terms provide only a general summary, the detailed Return & Refund Policy governs the return procedure and eligibility requirements, subject to applicable law.

11. Promotional Items and Free Gifts

Promotional items, free gifts, bonus products, complimentary accessories, and gift-with-purchase items are final sale and are not returnable, refundable, exchangeable, or eligible for store credit. Customers should keep these items and should not include them with a returned qualifying purchase.

If a qualifying purchased product is returned and the return is approved, the full retail value of each promotional item or free gift provided with that purchase will be deducted from the refund, as described in the Return & Refund Policy.

12. Limited Product Warranty

Eligible KOBO paddles are covered worldwide by KOBO's 12-Month Limited Paddle Warranty against qualifying manufacturing defects, subject to the conditions, exclusions, evidence requirements, and claim procedures stated in the KOBO Warranty Policy.

Normal wear and tear, cosmetic wear, misuse, abuse, accidents, unauthorized modifications, improper care or storage, impact damage, and customer preferences concerning feel, weight, balance, sound, or performance are not manufacturing defects.

Warranty claims are subject to review and approval by KOBO. The KOBO Warranty Policy is incorporated into these Terms by reference.

13. Product Use and Care

Customers are responsible for using KOBO products appropriately and following applicable product-care instructions. Sporting equipment naturally experiences wear through normal use.

Damage resulting from misuse, improper storage, unauthorized modification, inappropriate cleaning products, excessive impact, or use inconsistent with the product's intended purpose may not qualify for warranty coverage.

14. Intellectual Property

Unless otherwise stated, the KOBO name, logos, product names, product designs, website content, graphics, photographs, videos, text, software, trademarks, trade dress, and other intellectual property appearing on KOBO websites are owned by or licensed to KOBO Sports LLC.

No KOBO intellectual property may be copied, reproduced, distributed, modified, published, commercially exploited, or used to create derivative works without authorization, except as permitted by applicable law.

15. Reviews, Testimonials and User-Submitted Content

If you voluntarily submit a product review, testimonial, photograph, video, comment, or other content to KOBO, you represent that you have the right to submit that content.

Any use by KOBO of customer-created content will be subject to applicable law and any permissions, program terms, or agreements associated with the submission.

Customers may not knowingly submit fraudulent, misleading, unlawful, infringing, or impersonating content.

16. Website Use

You agree not to misuse KOBO's websites or services.

Prohibited activities include attempting to interfere with website operation or security, introducing malicious software, obtaining unauthorized access to systems or accounts, scraping or extracting protected content through prohibited means, impersonating another person, committing fraud, or using KOBO services for unlawful purposes.

KOBO may restrict access to its websites or services where reasonably necessary to protect customers, systems, intellectual property, or business operations.

17. Third-Party Services and Links

KOBO's websites may use or link to services operated by third parties, including payment processors, shipping carriers, social-media platforms, financing providers, analytics providers, and other service providers.

KOBO does not control independent third-party services and is not responsible for their separate websites, policies, availability, or practices. Use of third-party services may be governed by separate terms and privacy policies.

18. Privacy and Electronic Communications

KOBO handles personal information in accordance with its published Privacy Policy and applicable law.

By placing an order, creating an account, or contacting KOBO, you consent to receive transactional communications reasonably necessary to process your order, provide customer service, communicate shipping information, address warranty or return matters, and administer your relationship with KOBO.

Marketing communications are subject to applicable consent and opt-out requirements.

19. Fraud, Abuse and Policy Misuse

KOBO reserves the right to investigate suspected fraud, payment abuse, false claims, excessive or abusive return activity, warranty abuse, unauthorized transactions, or attempts to circumvent KOBO policies.

Where reasonably supported by the circumstances and permitted by law, KOBO may refuse transactions, returns, warranty claims, promotional benefits, or future orders associated with fraudulent or abusive activity.

20. Chargebacks and Payment Disputes

Customers are encouraged to contact KOBO Customer Support and allow KOBO a reasonable opportunity to investigate and resolve an order, delivery, return, or refund issue before initiating a payment dispute.

If a payment dispute or chargeback is initiated, KOBO may provide relevant records to the payment processor, financial institution, or other authorized party, including order information, tracking and delivery records, customer communications, return or warranty records, photographs, and applicable policies.

Nothing in these Terms limits rights that cannot lawfully be waived.

21. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, KOBO products, websites, and services are provided subject to the warranties and protections expressly stated by KOBO and any rights that cannot legally be excluded.

KOBO is not responsible for indirect, incidental, special, consequential, or punitive damages arising from the use of its websites, services, or products to the extent such limitation is permitted by applicable law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

22. Sporting Activity and Assumption of Risk

Pickleball and other sporting activities involve inherent risks of physical injury.

Customers are responsible for determining whether a product is appropriate for their intended activity, skill level, physical condition, and circumstances. KOBO products should be used responsibly and in accordance with their intended purpose.

Nothing in this section limits any rights or remedies that cannot be waived under applicable law.

23. Governing Law

These Terms and purchases from KOBO Sports LLC are governed by the laws of the State of Arizona, United States, without limiting any mandatory consumer-protection rights or jurisdictional rights that apply to a customer and cannot legally be waived.

24. Changes to These Terms

KOBO may update these Terms periodically to reflect changes in its products, services, operations, policies, technology, or legal requirements.

The version published on the KOBO website at the time of a transaction will apply to that transaction where appropriate, subject to applicable law. Updates will not retroactively remove rights that have already vested under applicable law.

25. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

26. Entire Agreement and Incorporated Policies

These Terms should be read together with KOBO's applicable published policies, including the Return & Refund Policy, Shipping Policy, Warranty Policy, Privacy Policy, and any promotion-specific terms applicable to the transaction.

These documents collectively form the applicable terms governing purchases and use of KOBO services. If a specific policy contains more detailed requirements for a particular subject, that specific policy will govern that subject to the extent permitted by applicable law.
